Terms of Service

These Terms govern your use of HyperMonitors. By creating an account or using the service you agree to them. If you use HyperMonitors on behalf of an organisation, you confirm you are authorised to accept these Terms for that organisation.

The service

HyperMonitors provides uptime and status monitoring: we run periodic checks against endpoints you configure, record the results, notify you of incidents, and publish status pages. The service is provided on a best-effort basis. We do not offer a service level agreement (SLA) on free tiers, and monitoring results may occasionally be delayed or missed due to factors outside our control.

Acceptable use

You may only monitor endpoints that you own or otherwise have explicit permission to monitor. You must not use the service to probe, scan or burden systems you do not control, or in any way that constitutes abuse. You must not use the alerting features — including SMS and webhook notifications — to send spam, harass others, or generate excessive or malicious traffic.

Account responsibilities

You are responsible for keeping your login credentials secure and for all activity under your account. You must provide accurate account information and promptly notify us of any unauthorised use.

Billing

Paid plans are billed monthly or annually through Stripe. Upgrading to a paid plan includes a first month free trial; unless you cancel before the trial ends, your subscription then renews automatically at the plan's rate. You can cancel at any time from the Stripe billing portal linked in your account. Cancellation stops future renewals but does not entitle you to a refund for partial billing periods.

Referral program

If the referral program is active, you can earn a commission on payments made by customers you refer, on the rate and earning window shown on your Referrals page at the time each referred customer signs up. Those terms are fixed for that customer even if we later change or end the program. We may change, suspend, or discontinue the program at any time; changes apply only to referrals made after they take effect.

Referrals are tracked with a first-party cookie set in the visitor's browser when they arrive through your link, and a referral can only be credited if that cookie is still present in the same browser when the person creates their account. It is therefore not possible to credit a referral where the visitor blocks, clears, or does not carry over that cookie — for example if they sign up on a different device or browser, use private browsing, or sign up after the tracking window shown on your Referrals page has elapsed. We cannot attribute a referral retroactively, and no commission is earned on a signup we did not track.

Commissions are earned only on genuine, arm's-length referrals. Self-referrals, referrals to accounts you control, and referrals obtained through spam, misleading claims, trademark or paid-search bidding on our brand, or any fraudulent or abusive means are not eligible and may result in removal from the program and forfeiture of unpaid earnings.

Payouts are made manually and are not automatic. An earning becomes payable only after it has been verified and after we have actually received and retained the underlying subscription payment from our payment processor (Stripe) free of any refund, chargeback, or dispute risk. Because card payments can be refunded or disputed for an extended period after they are made, earnings are subject to a holding period before they are eligible for payout. Earnings tied to a payment that is later refunded, reversed, or charged back are cancelled, and any corresponding amount already paid may be offset against future earnings.

Payouts are issued only once your verified, cleared balance reaches the minimum payout threshold and after the applicable holding period has elapsed. We may set and adjust the minimum threshold, the holding period, the accepted payout methods, and the payout cadence at our discretion, and we will make the current values available to program participants. This is necessary so that commissions are only ever paid from funds we have already received, to avoid cash-flow risk to the service.

You are responsible for any taxes owed on referral earnings and for providing any information we reasonably require to make a payout or to meet our legal and tax obligations. Referral earnings are a discretionary commission and do not create any employment, agency, partnership, or joint-venture relationship between you and us.

Disclaimers and limitation of liability

The service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that monitoring will be uninterrupted, error-free, or that it will detect every incident. To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential damages, or for losses arising from missed, delayed or inaccurate alerts. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

Termination

You may stop using the service and delete your account at any time. We may suspend or terminate accounts that violate these Terms or that create risk or legal exposure. On termination, your right to use the service ends and associated data is deleted in line with our Privacy Policy.

Governing law

These Terms are governed by the substantive laws of Switzerland, without regard to conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is the registered office of unaxus GmbH in Widnau, Switzerland, to the extent permitted by applicable mandatory consumer protection law.

Cookies

We set only first-party cookies — to keep you signed in, to remember your language and currency, and to credit a referral when you arrive through a referral link. We use no advertising or cross-site tracking cookies, so no cookie banner is shown. Every cookie we set is listed by name, purpose and lifetime in our privacy policy, and you can clear or block them at any time in your browser settings.
